Terms of Service &
Privacy Policy

1. Acceptance of Terms

By accessing, subscribing to, or using any services provided by HighImpct LLC ("we," "our," or "us"), you agree to be bound by these Terms & Conditions and our Privacy Policy. If you do not agree with any part of these terms, please discontinue using our services immediately.


PART I: TERMS OF SERVICE

2. Services We Provide

HighImpct LLC offers digital products and subscription-based services designed to streamline business operations. These services include, but are not limited to:

  • CRM and automation systems
  • AI agents and workflow automation
  • Business communication tools
  • Software integrations
  • Sub-accounts, workspaces, and team environments
  • Done-for-you setup and technical support

We reserve the right to improve, change, restrict, limit, or discontinue any service, feature, or integration at any time without prior notice.

3. Subscription & Payments

  • Billing: All payments are billed automatically through our authorized, secure third-party billing providers. Subscriptions renew automatically at the end of each billing cycle unless officially cancelled by the user.
  • Refunds: All payments and setup fees are strictly non-refundable unless stated otherwise in writing by a HighImpct LLC authorized representative.
  • Failed Payments: If a payment fails, your access to the platform, workflows, and AI agents may be paused or disabled until the outstanding balance is successfully processed.

4. Sub-Accounts & Ownership Policy

To maintain the security, integrity, and compliance of our software licensing, we enforce the following policies regarding sub-accounts:

  • Account Ownership: A sub-account is created under a master workspace owned by HighImpct LLC or its subsidiaries. However, all client data, contacts, and assets inside the sub-account belong exclusively to the paying customer who owns that workspace subscription.
  • No Transfers or Migrations: For security, privacy, and proprietary software licensing reasons, we strictly do not transfer, snapshot, or migrate sub-accounts to other agencies, GoHighLevel platforms, or external providers.
  • Cancellation & Data Retention: If you cancel your subscription, your account will be immediately paused. Sub-accounts and their associated data may be permanently archived or deleted after a reasonable grace period. It is your responsibility to export your contacts prior to cancellation.

5. Fair Use & Restrictions

You are granted a limited, non-exclusive license to use our platform. You agree not to:

  • Misuse the platform or engage in high-volume spam activities that disrupt server stability or violate communication laws (e.g., TCPA, CAN-SPAM).
  • Attempt to reverse engineer, decompile, duplicate, or resell our proprietary software, snapshot structures, or AI prompts.
  • Create harmful, fraudulent, or illegal workflows.
  • Breach or attempt to exploit the data privacy of other users on the platform.

Violation of these terms may result in immediate suspension or termination of your account without a refund.

6. Intellectual Property

All branding, platform interfaces, system architectures, templates, workflows, code scripts, documentation, designs, website content, and proprietary AI automation structures belong exclusively to HighImpct LLC. You are granted a license to use these assets while your subscription is active; you are not granted ownership. Copying, distributing, or reselling our materials is strictly prohibited.

7. External Links & Integrations

Many of our features rely on third-party APIs and tools (e.g., OpenAI, Stripe, Twilio, Zapier). We are not responsible for downtime, API changes, policy updates, pricing changes, or security issues caused by these third-party providers.

8. Limitation of Liability & Disclaimers

HighImpct LLC provides its services on an "as is" and "as available" basis. We make no guarantees regarding uninterrupted service, specific financial outcomes, or lead generation results. To the maximum extent permitted by law, HighImpct LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities arising from your use of our platform.


PART II: PRIVACY POLICY

9. Data Privacy & Protection

We take your data protection and business confidentiality seriously.

Information We Collect

  • Identifying information (Name, email, phone number, business details).
  • Account credentials and login details.
  • Usage data, analytics, and system performance logs.
  • Support conversations and files you choose to upload.
  • Billing information (handled securely by encrypted 3rd-party processors; we do not store full credit card numbers).

How We Use Your Data

We use your data strictly to provide, improve, and secure our services. This includes:

  • Powering your automation and CRM functionality.
  • Providing accurate customer support and troubleshooting.
  • Processing billing and preventing fraudulent activity.
  • Developing internal product improvements.

Data Sharing

We never sell, rent, or trade your personal or client data to outside marketers. Data is only shared with trusted processors necessary for essential operations, such as cloud hosting providers, payment gateways, and communication routing services (e.g., SMS/Email delivery). All selected vendors follow strict global compliance standards.

10. AI & Automation Systems

Certain features on our platform are powered by Artificial Intelligence (AI). Your data may be processed algorithmically by these AI providers to generate outputs, draft responses, or route conversations. This is always done under strict privacy conditions via secure API connections. We do not use your private business data or your clients' data to train public AI models.

We deploy industry-standard security protocols, including encryption in transit and at rest, to protect your data. However, no digital platform or cloud service is 100% immune to risks. By using our services, you acknowledge and accept that we cannot guarantee absolute, impenetrable data security against advanced cyber threats.

Technical support is provided according to your specific subscription plan tier. Support channels may include email, live chat, AI-assisted ticketing, or scheduled onboarding calls. Response times vary depending on ticket volume and your plan level.

13. Termination

We reserve the right to suspend or terminate your access immediately if you violate these terms, engage in platform abuse, or pose a security risk. You may cancel your subscription at any time through your billing dashboard or by contacting our support team prior to your next billing date.

14. Changes to Terms

HighImpct LLC reserves the right to update or modify these Terms of Service and Privacy Policy periodically to reflect changes in software, legal requirements, or business practices. Continued use of the platform after updates are published constitutes your formal agreement to the revised terms.
